West Berkeley Shellmound—Mapping the Victory
The Berkeley Architectural Heritage Association (BAHA) invited Sacred Land Film Project director Toby McLeod to tell the story of the successful, long-shot, eight-year battle to protect the West Berkeley Shellmound, which was led by Lisjan Ohlone leader Corrina Gould. His keynote speech on May 23, 2024 captured the drama, the collaboration, and valuable lessons learned in a #LandBack win of national and international significance.
For more information: Visit the BAHA website: www.berkeleyheritage.com/
A CORRECTION: It was not 2018, but February 18, 2021 when the California Court of Appeal for the First District heard oral arguments appealing Judge Roesch’s decision denying the SB-35 permit, which would have protected the sacred cultural site. On that same day, the landowners erected a six-foot chain link fence around the entire 2.2-acre site and topped it with three strands of barbed wire.
In the spirit of collaboration, Toby wants to thank the many colleagues and allies and family members who he did not have time to name and appreciate during this talk: Tom Lippe, Michelle Lee, Jessica Abbe, Fiona McLeod, Miles McLeod, Fui Niumeilolu, Ariel Luckey, Morgan Curtis, Callie Shanafelt Wong, Susi Alexander, Malcolm Margolin, Chris Walker, Claire Greensfelder, Lenore Goldman, Stephanie Manning, Markley Bavinger, Chris Oakes, Richard Schwartz, Perry Matlock, Cat the webmaster, Inés Ixierda, Denny Abrams, Rick Auerbach, Will Rogers, Dave Sutton, Christy Fischer, Brandon Moriarty, Patty Quillin, Reed Hastings, Polly McLeod, Regan Pritzger, Nwmaka Agbo and everyone at Kataly Foundation, Melissa Nelson, Julie and David Solnit, Kent Lightfoot, Lucy Gill, Jordan Brown, Ben Porter, Rick Freiss, Peter Prowes, Vince Medina, Andy Black, Dave Wendlinger, Brooke Anderson, Chris Dore, Winnemem Chief Caleen Sisk, Deb Haaland, Barbara Lee, Joanna Macy, Rucha Chitnis, Adam Glickman, the National Trust for Historic Preservation, and of course: Corrina Gould, Ruth Orta, Deja and Cheyenne Gould, Gregg Castro, Wounded Knee DeOcampo, Mayor Jesse Arreguin, Berkeley Councilmembers Sophie Hahn, Ben Bartlett, Rigel Robinson, Terry Taplin, Cheryl Davila, Susan Wengraf, Kate Harrison, Mark Humbert, Linda Maio, City Attorney Farimah Brown, and everyone at Sogorea Te’ Land Trust. Collaboration was the key to this victory!

Surrounded by boutique storefronts in the upscale Fourth Street shopping area of Berkeley sits an unassuming 2-acre parking lot. For 5,700 years this was an Ohlone village where two massive shellmounds grew-sites of burial and ceremony. Archaeologist Nels Nelson mapped and photographed the West Berkeley Shellmound in 1907. For many years Nelson's was the only photograph we could find of the shellmound, most of which had been carted away to fertilize farm fields and pave muddy streets. In 1950, U.C. Berkeley archaeologists hurriedly excavated what was left of the shellmound before what remained was finally leveled by industrial...

But every reservation I have been to, the animals are abused and starving. The people are in poverty and drunk. Of course not everyone. But the Natives, like most of the people in the world, including Americans, are not living up to our highest beliefs.

Here first? Africa took a million white slaves, that's why there are so many white people in Africa. Spain, England, Iran, all these places and many others were warring. And the Native people were warring tribes, and some here in TX were cannibals. They would do terrible things to other Native tribes. But the Natives we're conquered by others, and the American nation was founded, recognized on the world stage. But then America did something unheard of. They gave the conquered people land, freedom, money and tax free with your own gov unhindered by America. No country in the world ever treated the conquered with such goodness. Even to this day, free money, free education, and free land.

*looks into the Pope in 1493* *sees Alexander VI* 😬😬😬😬 As a Catholic it hurt to watch this. There are connections to our religion and the Native world view. But it was unfortunate the arrival of Europeans on to the Americas was sitting the papacy of one of the worst popes in history, a Borgia Pope. Did you know the eagle is the animal associated with the John the Evangelist? The Book of John is tied to stories of the divinity of Christ. The eagle feather in some Native American cultures represents communication with the divine or spirits or a being of this caliber. God saw His Creation and said it was good. We developed the sciences as a way to get closer to God. By understanding His creation we understand Him. The Eastern Catholic Churches show a good way to develop the Faith in other parts of the world moving forward. They kept their cultures, languages, and symbology. But they oriented it to Jesus and the Triune God. Our TLM and European expressions are ours but oriented to Jesus. May the Natives find their own cultures orient themselves to Jesus in the future. Viva Cristo Rey

The brilliant philosopher Simone Weil also preferred responsibility rather than rights. I think she would have liked to talk with Chief Oren Lyons. She wrote _The Need for Roots_ towards the end of World War II, along with an essay titled _Draft for a statement of human obligations._ Not human rights. Wikipedia: The work diagnoses the causes of the social, cultural and spiritual malaise which Weil saw as afflicting 20th century civilisation, particularly Europe but also the rest of the world. 'Uprootedness' is defined as a near universal condition resulting from the destruction of ties with the past and the dissolution of community. Weil specifies the requirements that must be met so that peoples can once again feel rooted, in a cultural and spiritual sense, to their environment and to both the past and to expectations for the future. In the book, she writes: "The notion of obligations comes before that of rights, which is subordinate and relative to the former. (…) An obligation which goes unrecognized by anybody loses none of the full force of its existence. A right which goes unrecognized by anybody is not worth very much. (…) A human being left alone in the universe would have no rights whatever, but would have obligations." "All human beings are bound by identical obligations, although these are performed in different ways according to particular circumstances. No human being, whoever they may be, under whatever circumstances, can escape them without being guilty of crime; save where there are two genuine obligations which are in fact incompatible, and one is forced to sacrifice one of them." "The first of the soul’s needs, the one which touches most nearly its eternal destiny, is order; that is to say, a texture of social relationships such that no one is compelled to violate imperative obligations in order to carry out other ones." "A consciousness of the various obligations always proceeds from a desire for good which is unique, unchanging and the same for every human being, from the cradle to the grave." "The great instigators of violence have encouraged themselves with the thought of how blind, mechanical force is sovereign throughout the whole universe. By looking at the world with keener senses than theirs, we shall find a more powerful encouragement in the thought of how these innumerable blind forces are limited, made to balance one against the other, brought to form a united whole by something which we do not understand, but which we call beauty."

not a dry eye in this house. Such gratitude to the steadfast faith-filled unstoppable @Corrina Gould! Such gratitude to the multitude who followed her, and gratitude for the elders of the Ohlone and the other tribal leaders of California and around the world, really, who stood with her, and gratitude and prayers for all those precious, treasured generations who follow her. I know that she would prefer I not single her out, but I have to say, there's no singling here. She steps on the beautiful steps of the ancestors, the guiding spirits, the grandmas and grandpas, aunties and uncles, the great ones that walked here during the best of times of Indigenous Law, Knowledge, and Care, and sacrificed and struggled greatly through the killing times, through the worst of times of suffocating greed and bureaucracy, which we all witnessed. Those who see Beauty and the impulse is to level it into business as usual always had designs on this Sacred Place, the last Sacred Place. Granny always said, good is stronger that evil. One Sacred Place will reveal what can happen with One Active Fought-For Sacred Place. There is miracle with Re-Matriation. Just wait and see. And here we are. Granny also said that Winnenem is a hard life, and that would be for every traditional de-colonized tribe's way of life, but it is the best life. May all of the Bay Area witness this truth, and FEEL it, and like the city council member who made motion and understands it is the most important thing she has done in her life, and like the elder who said, the Ohlone are still here, and like the joy expressed by faces for all the descendants and immigrants who came here, kidnapped or displaced. May it be so! Great blessings lie ahead. Transformation is right on the horizon with one, the last Shellmound. Corrina, such a momentous day we live in no matter what. Your leadership means everything to me. Love for you always. Misa
